U.S. Supreme Court Unlikely to Turn Back Clock on Gay Marriage: Attorneys with Greenspoon Marder Law believe Supreme Court will make same-sex marriage the law of the land

FORT LAUDERDALE, Fla., — The U.S. Supreme Court is expected to issue a landmark decision on same-sex marriage. On April 28, it will hold arguments to determine whether gay couples nationwide have a constitutional right to marry. Two issues will be addressed: whether the 14th Amendment requires a state to provide a marriage license to gay couples as it does straight couples and whether states must recognize same-sex marriages performed in other states. A decision is expected in late June.

The debate will be one of the most consequential of the 21st century. The District of Columbia and 36 states, including Florida, have legalized same-sex marriage. Attorneys from the Fort Lauderdale-based firm, Greenspoon Marder Law, believe the Supreme Court will reject same-sex marriage bans as unconstitutional.

“You can’t ‘unring’ the bell,” said attorney Myrna Maysonet. “The time is ripe both legally and socially for the Supreme Court to rule that the right to marry afforded by the Constitution extends to same sex-couples.”

U.S. courts have evolved gradually on this issue. In 2003’s United States v. Lawrence, the Supreme Court struck down a Texas sodomy law intended to criminalize gay unions. Then in 2013, the Supreme Court in U.S. v. Windsor struck down parts of the Defense of Marriage Act that limited the term “spouse” to heterosexual unions.

“When one considers the decision at Windsor, followed by numerous cases since in federal court in which the right of same-sex couples to marry has been recognized time and again, a clear trend emerges,” said Mark Rabinowitz, Chair of the Marital & Family Law Group. “I believe existing laws prohibiting gay couples from marrying will be overturned by the highest court in the land.”
