Overview

Anton N. Handal is the partner of Greenspoon Marder’s Intellectual Property and Litigation practice groups. He has 35 years of first-chair litigation experience in federal, state and administrative tribunals representing clients in over 100 trials.  Mr. Handal has argued several Federal Circuit Court of Appeal cases and has successfully tried cases in the International Trade Commission.  He has handled 17 IPR’s in Patent, Trademark Appeals Board matters and has won trial judgments and verdicts well in excess of $100,000,000.

Mr. Handal regularly advises clients on a variety of business and intellectual property transactions.  He has negotiated and documented business transactions valued at $130,000,000 and as the former CEO of a start-up technology company, he secured patents, directed financial transactions, negotiated contracts, raised capital and handled communications with shareholder/investors.  Mr. Handal has an active off-shore practice that includes advising and representing international companies on a variety of issues that range from doing business in the U.S. to defending off-shore clients in U.S. Court.  He serves the needs of Asia Pacific companies and individuals and has represented several Asian publicly traded companies.  He has an extensive network of affiliates throughout Asia to further the needs of his Domestic US clients that seek to do business overseas.

Mr. Handal is a relentless adversary who focuses his skills on complex business disputes involving breaches of fiduciary duty, partnership issues, professional liability, products liability, Lanham Act violations and patent litigation. Yet he is also a mentor to younger attorney’s teaching them the “why” to go along with the “how” of litigation practice.

Mr. Handal has been a featured speaker at webinars and conferences on various topics including: “Modern Trends in IP Litigation,” “From Decision to Practice” and “Building a Right Platform: Key Legal Issues of the U.S. Beauty Industry.”   He is a certified CLE lecturer in California and Florida on patent litigation topics; is a regular author and contributor on litigation topics; and is credited with several precedent setting court decisions.

  • Represented Plaintiff minority shareholders in shareholder derivative litigation alleging breach of fiduciary duty and violations of the Corporations Code relating to an international telecommunications business leading to a Judgment for Plaintiffs of more than $93,000,000, based on the value of misappropriated corporate property
  • RF Elati v. Aikin et al. Colorado District Court litigation recovering a $8,800,000 judgment for the firm’s client in a cannabis related business dispute.
  • Represented Plaintiffs/Respondents on appeal of six-figure sanction award for discovery misuse following Appellants/Defendants’ disobedience of discovery order, resulting in successful affirmance of the award in a published opinion by the Fourth Appellate District
  • Represented Respondent electronics manufacturing company in U.S. Customs and Border Protection Seizure cases concerning trademark validity. Filed successful Petition for Relief from Forfeiture resulting in dismissal of all cases and return of client property
  • Represented a world leading German manufacturer in re: Certain Automated Media Library Devices, U.S. International Trade Commission, Investigation No. 337-TA-746.  Mr. Handal represented five respondents in a Section 337 investigation involving automated data storage devices. Resulting in a complete victory after trial and appeal for the firm’s client.

Apple, Inc., et al., U.S. District Court for the Southern District of California, representing plaintiff patent holder in more than 20 patent infringement lawsuits against smartphone, tablet, and camera manufacturers and retailers in effort  to  enforce client’s flash memory-related patents
  • Patent Harbor, LLC v. Audiovox Corporation, et al., U.S. District Court for the Eastern District of Texas, Case No. 6:10-cv-361-LED-JDL, Federal Circuit Court of Appeals, Docket No. 13- 1341, representing defendant and appellee in patent infringement litigation involving technology for generating and displaying DVD content menus
  • Guardian Media Technologies, Ltd. v. Acer America Corporation, et al., U.S. District Court for the Eastern District of Texas, Case No. 6:10-cv-597-LED, representing three defendants in patent infringement litigation related to parental control technology for DVD players and TVs

  • Multimedia Patent Trust v. Directv, Inc., et al. U.S. District Court for the Southern District of California, Case No. 3:09-cv-278-JAH-CAB, obtained favorable settlement for defendant in patent infringement litigation involving MPEG-2 encoding and decoding technologies
  • Maldonado v. Belt Drives, Ltd., United States District Court for the Southern District of California, Case No. 3:08-cv-1431, obtained favorable settlement for plaintiff in patent infringement litigation related to a patented motorcycle brake design

  • Tan vs. Dolby, et al., U.S. District Court for the Northern District of California, Case No.05-cv- 3973, successful representation of a key female executive of a multinational firm in connection with claims of wrongful termination. This cornerstone case dealt with the rights of non-US resident women under the United States laws and Constitution to be free from workplace harassment
