Greenspoon Marder partners Rachel Gillette and James Mann to be featured speakers at the American Institute of Certified Public Accountants (AICPA) National Tax Conference in Washington, D.C. Ms. Gillette’s “Tax, Audits and 280E – Why me?” session will discuss taxes and audits are a harsh reality for most companies, but for cannabis businesses they are specially brutal because of IRC 280E. Section 280E prohibits any deduction of business expenses if the taxpayer’s trade or business consists of trafficking in controlled substances.

The organization sets ethical standards for the profession and U.S. auditing standards for private companies, nonprofit organizations, federal, state and local governments.
Rachel Gillette focuses her practice on marijuana/cannabis business licensing and regulatory compliance, business law and transactions, contract drafting and review, tax litigation, corporate formation, and tax matters, including audit representation. She also regularly represents clients before the IRS’s Examinations, Appeals, and Collections Divisions, including marijuana businesses facing the challenges of IRS adjustments under 280E.
James B. Mann has over 25 years of experience serving as a trusted advisor to a broad range of stakeholders in the energy and financial services industries. He counsels clients on the new changes in the tax law, as well as cannabis tax issues. Mr. Mann advises financial institutions regarding international tax, structuring renewable energy asset-based bank loans and securitizations, cross-border tax-advantaged partnerships and securitizations, project finance, and renewable energy deals.
