Greenspoon Marder Successfully Represents Client Before the Patent Trademark Appeal Board in Two Inter Partes Review Proceedings

Fort Lauderdale, FL – February 13, 2017 – Greenspoon Marder is pleased to announce that the firm’s Intellectual Property practice successfully represented client Pacific Market International, LLC (“PMI”) in two Inter Partes Review proceedings before the Patent Trademark Appeal Board (“PTAB”).

By way of background, Ignite USA, LLC filed the two complaints in the U.S. District Court in Chicago on February 3, 2016 for infringement by PMI of U.S. patents 9,095,233 (“the ’233 patent”); and 8,590,731 (“the ’731 patent”). In response, PMI filed Petitions before the PTAB to institute an Inter Partes Review of claims 1–23 of the ’233 patent; and claims 30 and 31 of the ’731 patent.

On February 5, 2018, the PTAB issued two respective Written Decisions determining PMI has shown by a preponderance of the evidence that claims 1-23 of the ‘233 patent and claims 30 and 31 of the ’731 patent are unpatentable.

The Greenspoon Marder team was led by partners Dr. Kelly Hollowell and Anton N. Handal.

“Both decisions are clean sweep victories for PMI” comments Dr. Kelly Hollowell. These two Inter Parte Review decisions will be reported to the U.S. District Court in Chicago with a request to dismiss the two stayed patent infringement actions.
