Have An Employee In Colorado? Ensure Compliance With New Labor Law

Effective on January 1st, there is a new law that will impact all employers with Colorado employees or operations. This new law is the Colorado Equal Pay for Equal Work Act (CEPEWA). In addition to conducting a pay audit to ensure that your employees are being paid fairly and equitably, the immediate actions employers should be aware of relate to job postings. First, employers need to post all job promotions. It is no longer lawful to promote an employee without allowing the rest of the eligible workforce an opportunity to apply for the position. Second, all job postings must include the anticipated salary of the posted job (a range is permissible) along with the available benefits. There are other important aspects of CEPEWA to include record keeping and prohibitions on requesting an applicant’s pay history. And, significantly, if an employer gets this wrong, an employee can file a lawsuit and/or face fines from the Colorado Department of Labor and Employment that range from $500 to $10,000 per violation.
