Newark, N.J. – November 8, 2023 – Greenspoon Marder senior counsel Kory Ann Ferro successfully represented a designer/contractor client in a personal injury case where the owners of the premises sought contribution and indemnification from the client as a third-party defendant.
The case arose from the defendants seeking to blame the firm’s client for the collapse of a staircase that was constructed approximately ten years prior. Ms. Ferro filed a motion to dismiss, arguing that the third-party complaint was deficient and failed to state a claim against the client as there was no privity of contract with the defendants, no contractual indemnification clause, the requirement to maintain insurance had long since lapsed, and the defendants had a non-delegable duty to maintain their own property. Ms. Ferro also asserted that the defendants’ claims were barred by the statute of limitations. The Court agreed with every argument and dismissed the case against the firm’s client.
