Greenspoon Marder Financial Services Update – State of Florida

On June 30, 2020 Florida Governor Ron DeSantis signed Executive Order 20-159 which extends previous Executive Orders 20-94 and 20-121 as it relates to Mortgage Foreclosures and Evictions until 12:01 AM on August 1, 2020.

Highlights of the previous Order which is now extended:

  • Suspension and Tolling any statute providing for a mortgage foreclosure cause of action under Florida law.
  • Suspension and Tolling any statute providing for an eviction cause of action under Florida law solely as it relates to non-payment of rent by residential tenants due to the COVID-19 emergency.
  • Nothing in the Executive Order shall be construed as relieving an individual from their obligation to make mortgage payments or rent payments
