On Wednesday September 30, 2020 the office of Florida Governor Ron DeSantis announced the Governor was allowing Executive Order 20-180 Limited Extension of Mortgage Foreclosure and Eviction Relief to expire. In doing so, no state level restrictions exist to completing the Final Action of a Foreclosure or Eviction action regardless of whether a COVID-19 related hardship exists or not.
Additional communication from the Governor’s Office suggest the Moratorium was allowed to expire to reduce confusion on the applicability of the CDC Eviction Moratorium which runs through December 31, 2020 as well as the Federal HUD/FHA and FHFA/Fannie Mae/Freddie Mac Foreclosure and Eviction Moratoriums which also run through December 31, 2020.
Loans in Foreclosure can now proceed without restriction in the State of Florida subject to the Federal Moratoriums still in place.
