On May 4, 2020 the Florida Supreme Court issued a new Administrative Order meant to extend, refine and strengthen the previously enacted temporary remedial measures put in place as a result of COVID-19. Unless specifically indicated otherwise the measures set forth in the Administrative Order remain in effect until the close of business on May 29, 2020. The highlights of the Administrative Order include the following:
- Jury trials remain suspended through 07/02/20;
- Notaries may continue to swear in a witness remotely by using audio-video communication technology within the state of Florida provided they can positively identify the witness;
- Case Management Conferences, Evidentiary and Non-evidentiary hearings and Nonjury Trials shall be conducted using telephonic or other electronic means unless a judge determines it would not be feasible or would be inconsistent with the Florida constitution;
- No proceedings other than those designated as essential shall be in person; and
- The requirement that the clerk issue a writ of possession “forthwith” remains suspended.
