New Jersey – April 9, 2026 – Greenspoon Marder partner Kelly Purcaro and senior counsel Kory Ann Ferro secured a total defense victory on behalf of Fly Alliance in Allan v. Fly Alliance Charter, LLC and Fly Alliance Maintenance, a New Jersey Conscientious Employee Protection Act (CEPA) case involving allegations of constructive discharge and whistleblower retaliation. The matter was originally brought to the firm by partner Joseph MacLellan.
On March 10, 2026, after the plaintiff rested his case-in-chief, the defense obtained a directed verdict dismissing Fly Alliance Charter from the trial. The Court reaffirmed the ruling on March 12, denying the plaintiff’s motion to re-add the entity as a defendant.
Following a trial spanning more than two weeks, the jury returned a unanimous verdict in favor of the defense on March 16. The jury found that the plaintiff failed to establish even the first element of a CEPA claim, determining that no reasonable person could have believed that any law, rule, policy, or regulation had been violated. The verdict resulted in a complete defense win.
