State of Florida: Broward County Foreclosure & Eviction Update

The 17th Judicial Circuit of Florida issued Administrative Order 2020-43-CIV on May 28, 2020.  This Order directly impacts foreclosure proceedings in Broward County, Florida.  The Administrative Order requires that all plaintiffs in residential foreclosure cases file a verified statement of compliance with the CARES Act.  (Attachment “A” of the Order)

The verified statement must be in the approved form and sworn to under penalty of perjury and provides:

  • If the subject property is Vacant or Abandoned
  • If the subject loan is:
    • A Federally backed mortgage loan insured by the FHA
    • A Federally backed mortgage loan but is not insured by the FHA
    • Not a Federally backed mortgage loan.

Additionally, No Final Judgments can be entered or Sales scheduled until the Verified Statement is filed.  This applies also to the rescheduling of previously cancelled Sales.

This Administrative Order takes effect on June 2, 2020 and expires at 12:01 a.m. on July 1, 2020.
