Representative Matters
- Represented NFL Wide Receiver Odell Beckham, Jr. against claims of assault, negligence, interference with prospective economic advantage, and defamation.
- Represented fabric printer in dispute against a Copyright holder who was alleging infringement of over thirty (30) copyrighted designs. After preemptively suing for breach of an oral license, first chaired a bench trial, securing judgment in client’s favor for $650,000 and a finding that the client had an oral license.
- Represented billion-dollar technology company in an action former customer, securing a $1 million-dollar judgment.
- Represented a technology company in a dispute with a terminated employee alleging breach of contract and religious discrimination. Resolved by a favorable settlement for the client.
- Represented Canadian distribution company in its claim against The Honest Company, Inc. for breach of a distribution agreement and fraud.
- Represented an organic electronic cigarette liquid manufacturer in a trademark suit brought by Virgin Enterprises, resulting in a favorable settlement whereby our client could continue using “virgin” as part of its overall name.
- Represented bio-diesel additive company in dispute with the California Air Resources Board regarding its improper approval of a competitor’s product.
- Represented film producer in dispute with his partner, where the partner was attempting to have the client judicially dissociated from their Limited Liability Company.
- Represented technology company in its dispute with a terminated employee who alleged breach of contract and religious discrimination. Resolved the matter by way of a favorable settlement for the client.
- Represented a New York-based apparel manufacturer in trademark dispute before the Trademark Trials and Appeals Board, where a competitor was seeking to cancel the client’s mark on grounds of abandonment. Secured a voluntary dismissal of the cancellation proceedings shortly before commencement of the trial period.
- Represented numerous apparel manufacturers in connection with Proposition 65 claims, all of which were expeditiously, and cost effectively resolved.
- Represented real estate investor accused of participating in a fraudulent transfer of several million dollars. Resolved by way of a favorable settlement for the client.
- Represented real estate investor in action against property management company and its insurance broker who colluded in an insurance fraud scheme. Secured a million-dollar settlement from the broker after the management company was placed in involuntary bankruptcy.
- Represented auto insurance carrier in dispute with its reinsurer over the reinsurer’s bad faith failure to secure its own policy of reinsurance and using the lack of such secondary reinsurance as justification to cancel its contract with the client. Resolved by way of favorable settlement for the client.
- Represented major on-line retailer in dispute regarding the retailer’s failure to put choking hazard warnings on its website. Secured dismissal at the trial court level on a Demurrer and anti-SLAPP Motion.
- Represented national retailer in design patent action regarding rope chain jewelry. Secured full insurance coverage for the client on a negotiated settlement shortly before trial.
- Represented national retailers in connection with industry wide actions brought under California’s Proposition 65, where the plaintiffs alleged a failure to warn consumers regarding the presence of chemicals known to the State of California to cause cancer or reproductive harm.
- Represented numerous garment manufacturers and national retailers in copyright infringement actions, reaching favorable settlements for the clients.
- Represented fabric companies in suits against third parties for infringement of their copyrighted designs, securing favorable monetary resolutions.
- Represented apparel company in a purported breach of warranty class action in Florida, securing dismissal in advance of class certification.
- Represented an apparel company in a multi-million-dollar action against Steve Madden, Ltd. and its subsidiary B.B. Dakota for fraud and breach of contract.
- Represented trademark licensee in a suit against its former attorney in connection with the lawyer’s conspiracy with its new client to defraud the licensee. After defeating pleading challenges and a motion for summary judgment, was able to secure a favorable settlement for the client.
- Represented the former majority owner of a major online marketplace in an adversary proceeding brought by a bankruptcy trustee asserting breach of fiduciary duty claims. Was able to secure a favorable settlement funded entirely by D&O insurance carrier.
- Represented the daughter of an award-winning cinematographer whose sister had convinced their mother (the father pre-deceased the mother) to disinherit the client in a written will that was executed shortly before passing away from brain cancer. Was able to secure a settlement whereby the client received her share of the approximately $10 million estate.
- Represented numerous e-commerce platforms in claims that their websites violated the Americans with Disabilities Act and California’s Unruh Act.
- Represented several e-commerce platforms against claims that their websites violated California’s Trap and Trace law through the use of marketing pixels and related technologies. In addition to resolving the claims, assisted the companies with identifying and implementing remedial steps to mitigate risk of future claims over the use of such technologies while minimizing the negative impact on consumer acquisition and retention.
- Represented retailers in connection with updating the terms of service and privacy policies on their websites, as well as providing advice and responding to claims regarding California’s Consumer Privacy Act.
- Represented an e-commerce company in a putative mini-TCPA class action involving SMS short codes, securing dismissal at the pleading stage.
- Represented QVC in a dispute involving alleged failure to include choking hazard warnings on its website, securing dismissal at the pleading stage.
- Represented a biodiesel additive company in a dispute with the California Air Resources Board (“CARB”) regarding the agency’s improper approval of a competitor’s product. After coordinating independent testing, and marshalling the necessary evidence to demonstrate how the competitor was able to defraud the State in its testing, CARB brought a civil fraud action against the competitor for $15 million. CARB ultimately secured an agreement that, in addition to providing monetary penalties, forced the competitor to cease all sales and leave the market entirely.
- Represented a real estate merchant bank handling more than $10 billion in structured transactions in dispute with borrowers who attempted to structure a sale of property to deprive the client of its share of the proceeds. Was able to parlay a preliminary injunction into a settlement that secured the client’s financial interest.
- Represented a real estate investor accused of participating in a fraudulent transfer of several million dollars. Resolved through a favorable settlement.
- Represented a secured lender and real estate investor seeking to recover control of a series of limited liability companies and their assets from a partner who had engaged in extensive self-dealing.
- Represented a real estate investor in an action against a property management company and its insurance broker, Lockton Insurance Brokers, who colluded in an insurance fraud scheme. Secured a $1 million settlement from the broker after the management company was placed into involuntary bankruptcy.
- Represented an auto insurance carrier in a dispute with its reinsurer involving the reinsurer’s bad faith failure to secure its own reinsurance coverage and its attempt to use that failure as grounds to cancel its contract with the client. Resolved by a favorable settlement for the client.
- Represented real estate developer in dispute with former partners and lenders relating to two $20 million residential developments. Among other things, was able to secure a reversal on appeal of the trial court’s denial of our client’s motion to compel arbitration against the lender who was seeking to enforce approximately $5 million in personal guaranties against our client.
- Represented the developer of a 145-unit senior living facility in a construction defect action involving improper design and installation of the HVAC system. Secured a settlement by which the client was compensated in full for the impact of the design errors on the property.
- Represented a general contractor in a dispute with its subcontractor regarding the parties’ respective rights and obligations under a $135 million master contract with a quasi-governmental agency and a $36 million subcontract.
- Represented an edible THC manufacturer in an action against its former landlord, who was seeking $2 million dollars in unpaid rent and in prosecuting a cross-action against the landlord for fraud and breach of contract. Secured a $6 million judgment, including attorney’s fees, against the landlord.
