Client Alert: Colorado Department of Revenue’s Marijuana Enforcement Division Initiates Annual Permanent Rulemaking Meetings

Attention Colorado marijuana business license holders:

Permanent rulemaking is set to begin on August 1 at 9 a.m. MST. The meetings will cover Science & Policy, Audit Implementation, Legislation Implementation, and Catch-all Rule Revisions and will run from August through October.

MED Initiates Annual Permanent Rulemaking Meetings (July 15, 2024)

 

Interested Parties:

The Colorado Department of Revenue’s Marijuana Enforcement Division (Division) is initiating its 2024 annual rulemaking process to implement Senate Bill 24-076, review and update existing rules, and propose new rules as necessary.

SB 24-076 is anticipated to become effective on August 7, 2024, following the expiration of the petition clause’s 90-day period. Therefore, the Division intends to adopt emergency rules for initial SB 24-076 implementation and will continue to develop new and revised rules through the permanent rulemaking process. As part of the permanent rulemaking process, the Division will facilitate the following stakeholder meetings to discuss proposed rule updates and solicit stakeholder feedback on the proposed rules:

How to Participate 

Attend meetings and participate in the discussion:

All members of the public can attend rulemaking meetings and participate in the discussion by signing up to provide comments. These structured stakeholder meetings will be focused on the announced topic(s) and will include time limitations on comments to ensure everyone who signs up to provide comment has an opportunity to do so. Feedback gained during the rulemaking stakeholder meetings will inform future meeting agenda items, discussions, questions, and the development of the Division’s proposed rules.

Submit written comments:

Interested stakeholders are also encouraged to submit comments on the draft rules using the Division’s written comment form. All comments submitted through this form are logged and reviewed throughout the rulemaking process to inform future meeting agenda items, discussions, questions, and the Division’s proposed rules.

The Division is preparing initial draft rules for review and input at the stakeholder meetings listed above. All agendas, draft rules, and any other materials will be posted on the Division’s website at least five (5) days prior to the meeting. Additionally, links for each meeting will be posted in advance on the Division’s Rulemaking webpage.
