Los Angeles, Cal. – February 23, 2023 – Greenspoon Marder LLP successfully represents Pasiphae Holdings, Inc. (Pasiphae) in the application of ex parte relief in the U.S. District Court for the Central District of California. The litigation team consisted of partner Kelly Magnus Purcaro and senior counsel Kory Ann Ferro, with senior counsel Joseph MacLellan serving as corporate counsel to Pasiphae.
Pasiphae, a wholesale supplier of personal protective equipment (PPE), purchased and owns over $4.9 million of PPE which it contracted to have stored by Defendants. Having discovered the products had been moved and that the Defendants were withholding access to same and attempting to sell it, a lawsuit was initiated on February 3, 2023. Following the filing of the complaint, the client was informed of possible attempts by Defendants to relocate the product from California to Dubai.
Our team swiftly and urgently filed an ex parte application for emergency relief and, having successfully demonstrated irreparable harm and a likelihood of success on the merits of Plaintiff’s claims, on February 18, 2023, the Court granted a temporary restraining order enjoining the Defendants from marketing, selling, encumbering, or relocating Pasiphae’s product.
”The Greenspoon Marder team is amazing. Joe guides me thoughtfully and skillfully on my transactions, while Kelly and Kory have been thorough, aggressive, and immediately successful on the litigation. I am thrilled with the legal services and responsiveness of the team. I look forward to ensuring the 179,190 boxes of Cranberry Evolve CT nitrile gloves are returned to Pasiphae as the rightful owner so that we may distribute them to parties in need of PPE,” said Federico Drada, Pasiphae President and CEO.
“The Order granting the restraining order was a big win for our client. We are pleased with the results and look forward to gaining additional relief for our client as the litigation progresses,” said Ms. Ferro.
