Greenspoon Marder Financial Services Updates – State of Florida Foreclosure/Eviction Moratorium Extended

On August 31st, 2020 Florida Governor Ron DeSantis signed Executive Order 20-2011 which extends previous executive order 20-180 until October 1, 2020.

EO 20-180 amends previous EO 20-94 to ensure mortgage foreclosure and eviction relief is limited to single-family mortgagors and residential tenants adversely affected by the COVID-19 emergency.

Executive Order 20-180

Suspends and tolls any statute providing for FINAL ACTION at the conclusion of a mortgage foreclosure proceeding under Florida law solely when the proceeding arises from non-payment of mortgage by a single-family mortgagor adversely affected by COVID-19 Emergency.
- (Adversely affected by COVID-19 emergency means loss of employment, diminished wages or business income or other monetary loss realized during the Florida State of Emergency directly impacting the ability of a single-family mortgagor to make payments).

The order reads the same as it relates to evictions.

Our office is reviewing our Florida portfolio in connection with the current HUD/FHFA moratorium in place to proceed on all applicable loans.
