Miami, FL – May 17, 2018 – A team of Greenspoon Marder attorneys prevailed on behalf of Miami nightlife venue E11even before the City of Miami’s Planning & Zoning Appeals Board in their request to expand and enclose the club’s rooftop terrace. Led by Louis J. Terminello, Chair of the firm’s Hospitality, Alcohol and Leisure Industry Group, the team secured a special exemption to enlarge the legal non-conforming adult use to the rooftop of the building and to enclose it with a soundproof and opaque covering to help mitigate any noise generated from the site.
E11even submitted an application for the special exception and a companion setback waiver after the Office of Code Compliance issued several citations to multiple entertainment venues in the ParkWest Entertainment District, including E11even, for alleged violation of noise ordinances in May 2017. The City’s approval of the application is significant for the entertainment sector in Miami as it is the first time since the enactment of the current zoning code that a non-conforming adult use was approved for expansion.
“This result is a win-win for all parties,” comments Mr. Terminello. “E11even expands its nightlife offering to its rooftop and the surrounding community gets the benefit of a soundproof and opaque rooftop enclosure which will eliminate any unlawful noise penetrating the residential community.”
