ORLANDO, FL – February 23, 2021 – Greenspoon Marder prevailed on behalf of our client, the School District of Manatee County, at the Second District Court of Appeal. The appellate court entered a per curiam affirmed decision, affirming the lower court’s dismissal of the litigation with prejudice.
The litigation began when the father of a School District of Manatee County student filed a suit challenging a suspension and disciplinary placement received by his child. Greenspoon Marder moved to dismiss the suit on numerous grounds including jurisdiction, mootness, and failure to state a claim. The Court agreed with Greenspoon Marder’s position and dismissed the case with prejudice. The Plaintiff appealed, with the Greenspoon Marder team prevailing once again in the appellate court.
