Homer successfully defended a longstanding telecommunications client against potentially business-ending regulatory enforcement following the Federal Communications Commission’s (FCC) expanded STIR/SHAKEN (Secure Telephone Identity Revisited / Secure Handling of Asserted Information using toKENs) requirements.
In 2020, the FCC adopted the STIR/SHAKEN framework, a caller ID authentication technology that was widely seen as a win for consumers in the fight against robocalls and spoofed solicitations.
In June 2025, the client, a trusted provider of automated communications for private ground transportation companies, was abruptly informed by one of the nation’s largest IP voice network carriers that its calls would no longer be permitted to pass through the carrier’s network. The carrier cited the FCC’s Eighth Report and Order, issued in November 2024, which imposed stricter requirements on intermediate providers, including prohibiting the use of third-party STIR/SHAKEN signing services and mandating direct digital certificate transmission with all outbound calls.
The client, which had long relied on the carrier to sign its traffic, was given little time to adjust to the new requirements and faced an imminent shutdown of its operations.
Within 24 hours, Greenspoon Marder’s Regulatory Compliance and Defense team conducted a comprehensive review of the client’s business model, prior to FCC filings, and current usage, and prepared a detailed memorandum outlining the legal basis for continued service. The team argued that the client’s operations fell outside the scope of the new obligations and that the carrier remained responsible for signing its traffic under the current reseller agreement.
The firm’s swift advocacy led to a favorable outcome: within two weeks, the carrier confirmed that its Legal & Compliance team had reviewed and accepted Greenspoon Marder’s position. The client was reclassified appropriately as a reseller, and the carrier acknowledged its responsibility to continue signing the traffic under a B-level attestation.
This resolution ensured uninterrupted service for Greenspoon Marder’s client and represented a successful defense against overly broad regulatory enforcement, preserving essential communications for thousands of downstream users.
