Miami, Fla. – March 15, 2021 – On behalf of cannabis company MRC44, Greenspoon Marder continues the fight against the City of Miami’s Commission to gain approvals for a certificate of use to open a cannabis dispensary in downtown Miami. MRC44 first applied for the certificate in 2019 and was denied based on guidance from the city attorney’s office. In November 2019, Greenspoon Marder appealed the city’s denial arguing that the city was violating state law by denying the application without an actual ordinance banning medical marijuana in Miami.
In a 7-4 vote, the Planning, Zoning and Appeals Board (PZAB) upheld the firm’s appeal affirming that MRC44 is entitled to a certificate of use. Despite the vote, the interim zoning administrator filed an appeal with the city commission opposing the PZAB’s ruling and maintaining the argument that federal law precludes the city from allowing marijuana dispensaries.
The Greenspoon Marder team, led by chair of the Hospitality, Alcohol & Leisure group Louis J. Terminello and senior counsel Joshua J. Remedios, will continue to push to open the dispensary with hope that the city will create cannabis legislation to clearly define its position.
