Fort Lauderdale, Fla. – November 3, 2025 – Greenspoon Marder partners John “Jack” Pelzer and Tina Garcia successfully represented client Louis P. Shassian in the Sixth District Court of Appeal of Florida, which reversed and remanded a partial final summary judgment entered by the Circuit Court for Orange County in a business dispute over a $1 million investment credit in a business dispute with Riverwalk Park, LLC investors.
The decision comes after the firm overcame significant jurisdictional hurdles to perfect appellate review, following an earlier dismissal for lack of jurisdiction due to case posture and subsequent corrective proceedings in the trial court to establish appellate jurisdiction.
In its opinion, the Sixth District held that genuine issues of material fact exist regarding whether Appellees agreed to invest $2 million in exchange for a $1 million investment credit and whether they waived or released any claim to the $1 million under an Agreement of Members resolving prior litigation, thereby rendering summary judgment improper. The court emphasized that conflicting evidence presented by both sides, none of which was blatantly contradicted by the record, must be resolved at trial rather than on summary judgment. The appellate court therefore reversed and remanded for further proceedings.
