Fort Lauderdale, Fla. – May 24, 2021 – Greenspoon Marder is pleased to announce partner Jeffrey A. Backman and senior counsel Tina Garcia successfully secured a defense arbitration award for client Orange Lake Country Club, Inc. (“Orange Lake”). The arbitration was tried over the course of three days by video conference, and all claims brought by the Claimants were denied.
The lawsuit was brought on behalf of the Claimants by the Austin Aaronson law firm, a law firm in the timeshare “exit” space. The Aaronson law firm represented the Claimants who entered into an agreement on September 10, 2018, with Orange Lake. The Claimants asserted claims for fraud and violations of the Tennessee Time-Share Act of 1981 and the Tennessee Consumer Protection Act of 1977 based on alleged misrepresentations made by Orange Lake Country Club’s sales agents. The Arbitrator sided with the defense put on by Mr. Backman and Mrs. Garcia, concluding that “[t]he Claimants’ claims in this arbitration are denied in their entirety, and no relief or damages are awarded.”
