Fort Lauderdale – July 23, 2025 – Greenspoon Marder LLP is pleased to announce a successful result in the appellate case of Ric Jorge, et al. v. City of Deerfield Beach, a matter of significant interest involving municipal rezoning decisions. The case was heard in the Circuit Court of the Seventeenth Judicial Circuit in and for Broward County, Florida, Appellate Division.
At issue was a petition for a writ of certiorari challenging the City of Deerfield Beach’s approval of a rezoning ordinance for property located along Federal Highway and NE 9th Avenue. The petition sought to overturn the City Commission’s decision to rezone the property to a Planned Development District, which was approved with conditions to support community infrastructure and accessibility enhancements. The appellate court denied the petition on the merits, affirming the City’s rezoning decision and clearing the way for continued progress on the project. Judges Bowman, Carbuccia, and Siegel issued a unanimous opinion in favor of the City and intervening parties.
Greenspoon Marder represented the intervenor in the proceedings, with Greenspoon Marder litigation partner John H. Pelzer and land use partner Dennis D. Mele. Mr. Pelzer led the appellate advocacy, with Mr. Mele acting as the land use attorney for the applicant during the rezoning process.
