Miami, FL – March 19, 2018 – Greenspoon Marder successfully secured a stay today of the enforcement of the Orders of the City of Miami Beach, allowing client Mokai Lounge to reopen after the City Manager revoked the nightclub’s Business Tax Receipt (BTR) and Certificate of Use (CU) earlier this month.
On March 9, the City Manager of Miami Beach entered an ex parte emergency order revoking Mokai’s Business Tax Receipt and Certificate of Use after the nightclub hosted an event in which a live horse was led into the venue. The City Manager claimed that the incident was “an actual threat to the public health, welfare and safety of the residents of Miami Beach.”
Today, the Greenspoon Marder team reached an agreement to restore the Mokai Lounge’s licenses, permitting the nightclub to resume operations on Wednesday of this week. Under the settlement, the nightclub must also pay a fine of $12,150, make a $10,000 donation to the Peaceful Ridge Rescue for Horses, and can no longer allow any animals in the venue except for service animals.
