West Palm Beach, FL – January 23, 2019 – Greenspoon Marder partner, Chris Draper, successfully represented a real estate client on an appeal before the Fourth District Court of Appeal for the State of Florida.
The case entailed the client personally guaranteeing a commercial lease. The initial lease was for three years and allowed for an extension of an additional three years. The landlord claimed that the lease included a continuing guaranty, however Mr. Draper was able to successfully establish that the guaranty was limited to the term of the lease and its solitary three-year option to renew. Thus, the guaranty was not a continuing guaranty. The Fourth DCA reversed the summary judgment entered against the Firm’s client and remanded the case back to the trial court for entry of judgment against the landlord.
