Las Vegas, NV – May 29, 2019 – Greenspoon Marder secured an award for attorneys’ fees and costs on behalf of client Westgate Las Vegas Resort, LLC in litigation against timeshare owners who were formerly represented by attorneys Austin Aaronson and Robert L. Hassett, III of Aaronson Law Group.
The timeshare owners filed a lawsuit against Westgate alleging claims for fraud, violations of various Nevada timeshare and consumer protection statutes as well as rescission. Throughout the proceedings, Westgate maintained that the claims were fraudulent and denied all allegations of wrongdoing. Less than one week before the owners were to be deposed by Westgate in preparation for trial, the owners voluntarily dismissed their complaint.
Westgate immediately filed a motion seeking prevailing party attorneys’ fees and costs and coordinated a hearing with the owners’ attorneys. Less than two weeks before the hearing, Aaronson Law Group withdrew from the case, leaving their clients without representation.
On May 13, 2019, Westgate received an award of attorneys’ fees and costs against the owners in the amount of $21,345.00.
The Greenspoon Marder team representing Westgate included partners Richard W. Epstein and Kathryn G. Saft and senior counsel Jennifer B. Hirschberg.
