Newark, N.J. – September 1, 2026 – Greenspoon Marder has secured a second win for client True Software Scandinavia AB, defeating a motion by Atlas Data Privacy Corporation to amend a dismissed complaint and add two new defendants to the case. The ruling, issued by Judge Harvey Bartle III of the U.S. District Court for the District of New Jersey, keeps the dismissal of the underlying action in place.
The case, Atlas Data Privacy Corporation v. True Software Scandinavia AB, centered on claims brought under New Jersey’s Daniel’s Law. The court dismissed the action against True Software on March 18, 2026, ruling that it lacked personal jurisdiction over the company. Fifty-one days after that dismissal, Atlas moved to amend the complaint to substitute Truecaller AB and Truecaller International LLP as defendants in True Software’s place.
Greenspoon Marder attorneys Kelly Purcaro and Kory Ann Ferro represented True Software in opposing the motion. The court agreed with their position, holding that the prior dismissal was a final order and that plaintiffs were required to meet the demanding standard for relief from judgment under Rule 60(b) of the Federal Rules of Civil Procedure. The court found no extraordinary circumstances justifying that relief, noting that plaintiffs knew about the Truecaller entities and True Software’s jurisdictional position well before the case was dismissed and chose to wait until after dismissal to seek the amendment. The court also found that plaintiffs’ delay in seeking to amend the complaint was undue under Rule 15.
