Greenspoon Marder Partner Dariel Abrahamy Secures Appellate Win for Lender in Florida Third District Court of Appeal

Boca Raton, Fla – August 21, 2026 – Greenspoon Marder is pleased to share that partner Dariel Abrahamy successfully represented a lender in an appeal before Florida’s Third District Court of Appeal, securing a ruling that affirmed the trial court’s handling of a foreclosure sale objection.

The case stemmed from a foreclosure action that a borrower delayed for nine years. After the property was sold at a foreclosure sale, the borrower objected through counsel, arguing that loss mitigation discussions with the lender should have stopped the sale. The trial court overruled the objection. The borrower moved for rehearing, submitting a payoff letter from the lender and information about refinancing the loan. The borrower argued the payoff letter required the lender to cancel the sale because the letter provided until after the sale to pay off the loan. The trial court denied the motion for rehearing, and the borrower appealed.

The appellate court affirmed the order overruling the objection to sale and the order denying rehearing. The appeal involved numerous issues, but the appellate opinion focused on the standard of review in these types of appeals. The appellate court, quoting from Greenspoon Marder’s brief, stated that a trial court does not abuse its discretion by denying a motion for reconsideration or rehearing that raises an issue that could have been, but was not, raised in the initial motion or at the initial hearing. The opinion reinforces the importance of properly addressing the standard of review on appeal.
