Los Angeles, Cal. – May 16, 2023 – Greenspoon Marder LLP successfully represents Pasiphae Holdings, Inc. (Pasiphae), a wholesale supplier of personal protective equipment (PPE), in a lawsuit seeking the return of any damages related to Defendants’ withholding of and attempted sale of over $4.9 million of Pasiphae’s PPE. The litigation team consists of partner Kelly Purcaro and senior counsel Kory Ann Ferro, with senior counsel Joseph MacLellan serving as Pasiphae’s corporate counsel.
Following a victory in February 2023, wherein the Court granted Pasiphae’s ex parte application for emergency relief by instituting a temporary restraining order enjoining the Defendants from marketing, selling, encumbering, or relocating Pasiphae’s product, the Greenspoon Marder team again prevailed. On the return of the Order to Show Cause, the Court has granted Pasiphae the immediate return of the entirety of its product without the need to post any bond for the release and return. In rendering its decision, the Court determined that Pasiphae was the original purchaser of the PPE, that there was a contractual relationship with Defendants to store the PPE, and that Defendants then refused to return the PPE despite Pasiphae’s demands. The Court dismissed Defendants’ arguments that they had agency rights to the PPE or that they had any right to withhold the PPE from Pasiphae. As such, the Defendants must release and return the product to Pasiphae now without exception unless it is willing to pay for the full value of the product in order to challenge the judge’s order.
