The Oregon Legislature recently passed SB 218, authorizing the OLCC to limit marijuana producer licenses and changing the way the OLCC may process producer license applications going forward. Under SB 218, the OLCC may only process applications for producer licenses if the application was received prior to June 15, 2018. Further, applicants who submitted an application for a producer license on or before June 15, 2018 may NOT change:
- a) the location for which the application was submitted; or
- b) 51% or more of the ownership of the production facility or premises.
The bill has not been signed by the Governor, but once it is, these changes take effect.
If you have a pending application for a producer license, and you want to make either of the above changes, please contact our office ASAP, as the Governor could sign the bill any day. Also if you have an application for a producer license for which you have not yet submitted a Land Use Compatibility Statement (LUCS), please also contact our office. LUCSs for producer license applications submitted by June 15, 2018 must be submitted within 21 days of the effective date of SB 218.
Please note that SB 218 does not affect ownership or location changes for existing producer licenses; it only affects producer license applications.
