Greenspoon Marder Attorneys Robert Rando and Monifa Hall Secure Victory in Palm Beach County Circuit Court

Fort Lauderdale, Fla. – February 9, 2024 – In a significant legal victory, Greenspoon Marder partner Robert J. Rando and associate Monifa Hall secured the final judgment for firm client Cheryl Milone Cowles in the Circuit Court for Palm Beach County. The case involved Ms. Cowles’ pursuit of specific performance from the defendant who breached a contract for the sale and purchase of real property.

Following Ms. Cowles’ motion for summary judgment, a final judgment favored Ms. Cowles when the defendant failed to respond or attend the hearing. Subsequently, the defendant filed a motion to vacate the judgment, as well as an amended motion to vacate, alleging a violation of due process due to a lack of notice.

Despite these legal maneuvers, the court, in a hearing attended by Mr. Rando and Ms. Hall, promptly denied the motion to vacate. The Court emphasized that the defendant’s own evidence demonstrated that he had received and confirmed actual notice of the hearing. The defendant then sought a “third bite at the apple” with a motion for reconsideration which the Greenspoon team also successfully opposed as per the Court’s recent Order denying the motion for reconsideration. With this motion denied, the parties can now proceed with the closure of the real estate deal, bringing satisfaction to Ms. Cowles.
